Supreme Court suspends proceedings on Ogah vs Governor Ikpeazu as judge recuse herself from the matter.

Proceedings at the Supreme Court in the Uche Ogah versus Governor Ikpeazu tax matter was suspended today following the decision of Justice Amina Augie to recuse herself from the matter.

It will be recalled that Justice Amina Augie JSC, who was recently elevated to the Supreme Court (October 2016) from the Appeal Court, was rumored to have been heavily involved in the Otti versus Ikpeazu election petition matter at the Appeal Court.

 

In that matter the Appeal Court on the 31st of December 2015 ruled in favor of Alex Otti but the decision was later upturned by the Supreme Court which ruled that the Appeal Court erred in law and miscarried justice against Governor Okezie Ikpeazu.


Some groups in Abia recently  suggested that Justice Augie is from Uturu in Isuikwuato LGA of Abia State (where Uche Ogah is also from) but married to a northerner. If that is true, it is plausible that she will be an interested party in the matter and hence was right to recuse herself.

 


It will also be recalled that yesterday social media activists and platforms linked to Uche Ogah published that today's proceedings at the supreme court will be postponed with one source citing change of panel members as reason. Whereas as at yesterday the identity of panel members that will hear the case was still supposed to be a closely guarded secret in the hands of the administrative leadership of the apex court.

 


Following the voluntary exit of Justice Amina from the matter, proceedings were adjourned sine die to enable her replacement. A new date will be communicated to the parties later by the Supreme Court.
